1. General points

1.1. The General Terms and Conditions (hereinafter referred to as GTC) govern the comprehensive terms and conditions between SOFTRIDGE AG and you. 
 

2. Offer

2.1. The offer is aimed at you who are resident in Switzerland or the Principality of Liechtenstein. The offers are subject to change and are not to be understood as binding offers.

2.2. You will receive an order receipt confirmation, which is not binding. We reserve the right not to accept orders if more than normal household quantities of an item are ordered. An order is only concluded by confirming the shipment or the willingness to pick up the ordered goods.


3. Ordering, Delivery and Cancellations

3.1. Orders placed on account (Powerpay) are only accepted via the www.softridge.ch website and are only available to customers of legal age. If, after the confirmation of receipt of the order, it is determined that an item is not available, the corresponding order will be cancelled. You cannot assert any further claims. The delivery period stated in the offer or in the order receipt confirmation is only a guide and is not binding.

Orders placed before 5:30 p.m., if in stock, will be shipped the same day.
Pre-ordered products will be delivered on the specified release date.
All publication dates are subject to change.

3.2. Partial deliveries are possible. If part of the ordered goods cannot be delivered, there is no right to cancel the entire order. You cannot assert any further claims.

3.3. Delivery is made exclusively to addresses in Switzerland and the Principality of Liechtenstein at your expense and risk. You have the option of choosing the fee-based shipping method "Registered" when ordering, which ensures that the ordered goods are insured in the event of transport damage/loss.

Swiss Post's liability depends on the shipping service selected. In the event of damage, loss or incorrect delivery, the following maximum compensation amounts apply:

Please note: Swiss Post accepts no liability for uninsured consignments such as A letters.

Therefore, we recommend choosing the option "Registered CHF 5 (insured)" from a net value of CHF 500. For a net value of goods of CHF 500 or more, this shipping method will be selected automatically, but you can change it at any time. If a change is made, this is at your own risk: In the event of loss or damage, it is not the post office that is liable, but the sender. In principle, there is no liability for letter mail, except if it is sent "by registered mail" (liability up to a maximum of CHF 500).

In principle, in the case of a generic purchase, the benefit and risk only pass to you when the item has been eliminated or, in the case of shipping, when it has been handed over for dispatch (Art. 185 para. 2 CO). A report of theft must be filed with the police.
In the event of damage, we will always try to find a quick solution with Swiss Post.

The assumption of the transport costs by SOFTRIDGE AG agreed on a case-by-case basis has no influence on the transfer of benefit and risk.

3.4. You undertake to immediately check the delivered/collected goods for accuracy, completeness and integrity. Damage to the delivered/collected goods must be reported as soon as possible, but no later than within 3 calendar days. In case of complaints, all parts of the original packaging must be retained.

3.5 Cancellation of an order: Cancellations are made exclusively via the "Customer Account" in the "Admin Area" under "Orders". They are usually free of charge and can be done without any problems as long as the order has not yet been placed. However, if the product or order has already been triggered, you are obliged to purchase the item. Orders for online exclusive products cannot be cancelled as they are procured exclusively for you.

3.6 Package not received (theft, loss, theft) If a parcel has not arrived (e.g. due to theft, loss or theft), this must be reported immediately and in writing to info@softridge.ch by e-mail. In such cases, you are obliged to file a police report. A copy of the notification must be provided to us so that we can forward the case to the post office for further clarification if necessary.

Is the package insured? Please note, point 3.3 of our terms and conditions: With the shipment of the goods, the benefit and risk pass to you. This means that you bear the risk of loss or damage to the goods from the time of shipment.

Why do I still have to pay the invoice?
Since, according to the terms and conditions, the transfer of risk takes place when the parcel is handed over to the shipping service provider, the purchase contract remains valid regardless of the arrival of the parcel at the recipient.
This means that you are obliged to pay – even if the package is lost on the way.
 

Prices & Quantities

4.1 We reserve the right to change the price at any time. The price published at the time of ordering applies. Price changes made after the order has been placed will not be taken into account.

4.2. All prices include VAT and advance recycling fee (VRG) in Swiss francs. Technical changes, errors and printing errors are reserved.

4.3 If obviously incorrect prices are inadvertently displayed in the Online Shop (e.g. due to technical errors, input errors or transmission errors), we are not obliged to accept orders at these obviously incorrect prices.
In such cases, we reserve the right to cancel the order in question and to inform you immediately. In this case, payments already made will be refunded immediately.

4.4 We reserve the right to adjust the orders unilaterally, as we only sell to the end consumer in commercially available quantities. Our goal is to be able to serve as many different customers as possible.


5. Payment

5.1. The means of payment indicated on www.softridge.ch apply. Individual means of payment can exclude without further justification in general or for individual customers. We reserve the right to obtain credit checks about you. For this purpose, your data may be transferred to third parties.

Purchase on account with instalment payment option (PowerPay):

In the case of purchase on account (PowerPay), you are obliged to pay the invoice amount within 10 calendar days of receipt of the delivery, otherwise the instalment payment option will apply.

MF Group / PowerPay offers the payment method "purchase on account" as an external payment service provider. With the order invoice, you can easily pay for your online purchase by invoice. If you do not pay within the specified time frame, you will receive a monthly invoice with an order summary in the following month.

When concluding the purchase contract, PowerPay takes over the invoice claim and processes the corresponding payment modalities. If you purchase on account, you accept the terms and conditions of PowerPay in addition to our terms and conditions. (powerpay.ch/de/agb). 5.2. In the case of purchases made with credit cards, the charge will be made at the time of ordering. When paying by credit card, the data is transmitted in encrypted form (SSL). In the case of purchase on prepayment, the order will only be triggered as soon as the corresponding payment  has been received. If the availability of goods is scarce, it may happen that goods with the status "available from stock" can no longer be delivered immediately until the order is placed. If the payment is not received within 7 days, the order will be automatically cancelled. If it is agreed that the ordered goods will be picked up by you in a store, the entire purchase price must be paid at the time of collection.


6. Warranty and repairs

6.1 Return and exchange policy

You do not have a general right of return and exchange. The invoice is considered a guarantee certificate. This must be kept carefully. In any case, the return  must be requested in writing via e-mail. A return is possible within 5 days after receipt of the goods. The date of delivery is decisive. The goods must be returned in their original packaging, in their entirety. It is at your expense and risk. We recommend sending it by registered mail or A Post Plus.

Important: Digital products such as (prepaid cards, subscriptions and digital add-ons) are excluded from the right of return and exchange and cannot be returned or cancelled afterwards.

6.2 Procedure for defective devices

You can claim a defect in the device, as long as there are no reasons for exclusion. Reasons for exclusion can be, in particular, damage caused by natural forces, moisture damage, impact or fall damage, natural wear and tear, software problems, incorrect manipulation, damage caused by external influence as well as interference with the product or its modification. Excluded from the warranty are wearing parts, batteries, rechargeable batteries. If there is a defect that does not fall under the exclusion reasons, contact the service center defined by the manufacturer. In any case, the return must be discussed with us in advance. Otherwise, a compensation in the amount of CHF 25.00 can be claimed.

Defective devices will not be collected. You must send the defective device to the designated service point or return it to the designated location at your own expense and risk. The devices must be sent in with all accessories in their original packaging with the enclosure of the sales receipt.
If it is determined that a device sent in is not covered by the warranty, a cost estimate of the expected repair costs is automatically created.

6.3 Warranty period and manufacturer's warranty

The warranty period for new devices is 2 years*. Warranty replacement or repair will not result in an extension of the original warranty period. The warranty does not limit the legal warranty obligation.

You must claim this directly at the service center designated by the manufacturer. You acknowledge that the manufacturer's warranty provisions usually only provide for a right to repair or exchange (replacement), unless there are reasons for exclusion. You are not entitled to claims for damages or compensation for damages.

The decision on the type of defect remedy usually lies with the manufacturer. For the duration of the repair or the time until a replacement device is delivered, there is no entitlement to a free replacement device. If the defective device is replaced by the manufacturer, the replacement device is adjusted to the current value of the defective device. If a device is repaired or replaced, this will not result in an extension of the original warranty period.


7. Liability

Claims for damages arising from impossibility of performance, breach of contract, negligence at the time of conclusion of the contract and tort are excluded, unless intentional or grossly negligent action is present. Liability for indirect damages and consequential damages resulting from use, error or failure to perform is excluded.
 

8. Privacy Policy

SOFTRIDGE attaches great importance to data protection as well as to openness and transparency in the processing of personal data. For this reason, we explain how we protect personal data processed.

8.1 Who is responsible for personal data?

The Swiss company SOFTRIDGE AG is responsible for the personal data of data subjects in accordance with the applicable data protection law. 

8.2 Where is personal data stored?

The data we collect from you is stored in Switzerland, but may also be transferred to and processed in a country outside Switzerland. The disclosure of personal data is carried out in accordance with applicable law.

8.3 Who has access to your data?

Personal data may be shared within SOFTRIDGE.

Disclosure, sale and exchange of personal data to third parties for marketing purposes is excluded. The disclosure of data to third parties serves exclusively to be able to provide you with our services.

8.4 What is the legal basis for the processing?

For any specific processing of personal data that we collect, we will inform you whether the provision of personal data is required by law or necessary to enter into a contract, as well as whether personal data must be provided and the disadvantages of not providing it.

8.5 What are the rights of data subjects?

Right of access:
You have the right to request information about your data stored by us at any time. You can contact SOFTRIDGE to receive your personal data via email.

Right to data portability:
If SOFTRIDGE processes personal data using automated means, based on a data subject's consent or on a contract, you may request that a copy of the data be sent to you. This only applies to personal data that you have provided to us.

Right to rectification: 
You have the right to request the correction or completion of your personal data if it is inaccurate or incomplete.
Data subjects who have an account with SOFTRIDGE may edit their personal data.

Right to erasure:
You have the right to erasure of your personal data processed by SOFTRIDGE at any time, except in the following cases:

* if there is an obligation to keep accounts and store data in connection with a purchase/purchase and personal data must be stored.

Right to object to data processing in the event of legitimate interest: 
You have the right to object to the processing of your personal data based on SOFTRIDGE's legitimate interest. In this case, we will only process the personal data further if we can demonstrate a lawful reason for the process that overrides the interests and rights of the data subject.

Right to lodge a complaint with a supervisory authority: 
If you believe that SOFTRIDGE is incorrectly processing your personal information, you may contact us. You also have the right to lodge a complaint with a supervisory authority.

Updates to our privacy policy:
Occasionally, we need to update our Privacy Policy. The latest version of the Privacy Policy is always available on our website. We will inform you of any significant changes to the Privacy Policy, such as the purpose for using personal data.

8.6 Retention obligation / deletion of data

The data will be kept for 10 years and then deleted after the end of the contractual relationship.
 

9. Place of jurisdiction, applicable law

These General Terms and Conditions of Sale may be amended at any time. Swiss law is exclusively applicable.
The place of jurisdiction is Zurich.
