1. General points

1.1 . The General Terms and Conditions (hereinafter referred to as GTC) govern the comprehensive terms and conditions between SOFTRIDGE AG and its customers. 
 

2. Offer

2.1 . The offer is aimed at customers residing in Switzerland or the Principality of Liechtenstein. The offers are subject to change and are not to be understood as binding offers.

2.2 . The customer receives an order confirmation, which is not binding. We reserve the right not to accept orders if more than the usual household quantities of an item are ordered. An order is only concluded by the confirmation of the dispatch or the willingness to pick up the ordered goods.


3. Ordering, delivery and cancellations

3.1 . Orders against invoice (Powerpay) are accepted exclusively via the website www.softridge.ch and is only available to adult customers. If, after the order confirmation, it is determined that an item is not available, the corresponding order will be cancelled. The customer cannot assert any further claims. The delivery period stated in the offer or in the order confirmation is only a guideline and is not binding.

Orders placed by 5:30 p.m., if in stock, will be shipped the same day.
Pre-ordered products will be delivered on the specified release date.
All release dates are subject to change.

3.2 . Partial deliveries are possible. If part of the ordered goods cannot be delivered, there is no right to cancel the entire order. The customer cannot assert any further claims.

3.3 . Delivery shall be made exclusively to addresses in Switzerland and the Principality of Liechtenstein at the expense and risk of the customer. When ordering, the customer has the option of choosing the paid option A Post or Registered Mail, which ensures that in the event of transport damage/loss, the ordered goods are insured.

3.4 . The customer undertakes to immediately check the delivered/collected goods for correctness, completeness and integrity. Damage to the delivered/collected goods must be reported as soon as possible, but no later than within 3 calendar days. In the event of complaints, all parts of the original packaging must be kept.

3.5 Cancellation of an order: Cancellations are made exclusively via the " Customer Account" in the "Admin Area" under "Orders". They are usually free of charge and possible without any problems, as long as the order has not yet been placed. However, if the product or order has already been placed, the customer is obliged to purchase the item. Orders for online exclusive products cannot be cancelled, as they are procured exclusively for the customer. 


4. Prices & Quantities

4.1 We reserve the right to change the price at any time. The price published at the time of the order applies. Price changes made after the order has been placed will not be taken into account.

4.2 . All prices include VAT and advance recycling fee (VRG) in Swiss francs. We reserve the right to make technical changes, errors and misprints.
4.3 We reserve the right to unilaterally adjust the orders, as we only sell to the end consumer in customary quantities. Our goal is to be able to serve as many different customers as possible.


5. Payment

5.1 . The means of payment specified on www.softridge.ch apply. Individual means of payment can be excluded in general or for individual customers without further justification. We reserve the right to obtain credit checks about the customer. For this purpose, customer data may be passed on to third parties.

Purchase on account with installment option (PowerPay):

In the case of purchase on account (PowerPay), the customer is obliged to pay the invoice amount within 10 calendar days of receipt of the delivery, otherwise the installment payment option comes into effect.

As an external payment service provider, MF Group / PowerPay offers the payment method "purchase on account". With the order invoice, you can easily pay for your online purchase by invoice. If you do not make a payment within the specified time frame, you will subsequently receive a monthly invoice with an order overview in the following month.

Upon conclusion of the purchase contract, PowerPay takes over the invoice claim and processes the corresponding payment modalities. When purchasing on account, you accept the terms and conditions of PowerPay in addition to our terms and conditions. (powerpay.ch/de/agb). 5.2 . When purchasing with credit cards, the charge will be made at the time of the order. When paying by credit card, the data is transmitted in encrypted form (SSL). When purchasing in advance, the order will only be triggered as soon as the corresponding payment  has arrived. In the event of scarce availability of goods, it may happen that goods with the status "available from stock" can no longer be delivered immediately until the order is triggered. If the payment is not received within 7 days, the order will be automatically cancelled. If it is agreed that the ordered goods will be picked up by the customer in a branch, the entire purchase price must be paid at the time of collection.


6. Warranty and repairs

6.1 Right of return and exchange

The customer has no general right of return and exchange. The invoice is valid as a guarantee certificate. This must be stored carefully. In any case,  the return must be requested in writing via e-mail. A return is possible within 5 days after receipt of the goods. The date of delivery is decisive. The return of the goods must be complete in their original packaging. It is carried out at the expense and risk of the customer. We recommend sending via registered mail or A Post Plus.

Important: Digital products such as (prepaid cards, subscriptions and digital add-ons) are excluded from the right of return and exchange and cannot be subsequently returned or cancelled.

6.2 Procedure in case of defective devices

The customer can claim a defect in the device, provided that there are no grounds for exclusion. Grounds for exclusion may include, but are not limited to, natural wear and tear, moisture damage, impact or fall damage, natural wear and tear, software problems, incorrect manipulation, damage caused by external influences and interventions in the product or its modification. Excluded from the warranty are wear parts, batteries, rechargeable batteries. If there is a defect that does not fall under the grounds for exclusion, the customer shall contact the service center defined by the manufacturer. In any case, the return must be discussed with us in advance. Otherwise, a handling fee of CHF 25.00 can be claimed.

Defective devices will not be picked up. The customer must send the defective device to the designated service point at his own expense and risk or return it to the designated location. The devices must be sent with all accessories in their original packaging with the sales receipt attached.
If it is determined that a returned device is not covered by the warranty, a cost estimate of the expected repair costs is automatically generated.

6.3 Warranty period and manufacturer's warranty

The warranty period for new devices is 2 years*. Warranty replacement or repair will not result in an extension of the original warranty period. The warranty does not limit the statutory warranty obligation.

The customer must claim these directly from the service center designated by the manufacturer. The customer acknowledges that the manufacturer's warranty provisions generally only provide for a right to rectification (repair) or replacement (replacement), unless there are grounds for exclusion. The customer is not entitled to claims for damages or compensation for handling.

The decision on the type of defect rectification usually lies with the manufacturer. For the duration of the repair or the time until the delivery of a replacement device, there is no entitlement to a free replacement device. If the defective device is replaced by the manufacturer, the replacement device will be adjusted to the current value of the defective device. Repairing or replacing a device does not extend the original warranty period.


7. Liability

Claims for damages due to impossibility of performance, breach of contract, negligence at the time of conclusion of the contract and tort are excluded, unless there is intentional or grossly negligent action. Liability for indirect damages and consequential damages resulting from use, error or loss of performance is excluded.
 

8. Privacy Policy

SOFTRIDGE attaches great importance to data protection as well as openness and transparency in the processing of personal data. For this reason, we explain how we process personal data, protect it.

8.1 Who is responsible for personal data?

The Swiss company SOFTRIDGE AG is responsible for the personal data of data subjects in accordance with the applicable data protection law. 

8.2 Where is personal data stored?

The data we collect from our customers is stored in Switzerland, but may also be transferred to a country outside Switzerland and processed there. The disclosure of personal data takes place in accordance with applicable law.

8.3 Who has access to your data?

Personal data may be passed on within SOFTRIDGE.

Disclosure, sale and exchange of personal data to third parties for marketing purposes are excluded. The disclosure of data to third parties serves exclusively to be able to provide our services to our customers.

8.4 What is the legal basis for the processing?

For each specific processing of personal data that we collect, we inform our customers whether the provision of personal data is required by law or necessary to conclude a contract, as well as whether personal data must be provided and what the disadvantages are if it is not provided.

8.5 What are the rights of data subjects?

Right of access:
Data subjects have the right to request information about their data stored by us at any time. Data subjects may contact SOFTRIDGE to receive their personal data by e-mail.

Right to data portability:
If SOFTRIDGE processes personal data using automated procedures, based on the consent of a data subject or on a contract, the data subject may request that a copy of the data be served on him or her. This only applies to personal data provided to us by the data subject.

Right to rectification: 
The data subject has the right to request the correction or completion of his or her personal data if it is incorrect or incomplete.
Data subjects who have an account with SOFTRIDGE may process their personal data.

Right to deletion:
Data subjects have the right to have their personal data processed by SOFTRIDGE deleted at any time, except in the following cases:

* if there is an obligation to keep records and store data in connection with a purchase/purchase and personal data must be stored.

Right to object to data processing in the event of a legitimate interest: 
Data subjects have the right to object to the processing of their personal data based on the legitimate interest of SOFTRIDGE. In this case, we will only continue to process the personal data if we can demonstrate a lawful reason for the process that takes precedence over the interests and rights of the data subject.

Right to lodge a complaint with a supervisory authority: 
Data subjects who believe that SOFTRIDGE is processing their personal data incorrectly can contact us. They also have the right to lodge a complaint with a supervisory authority.

Update of our privacy policy:
From time to time, we may need to update our Privacy Policy. The latest version of the Privacy Policy is always available on our website. We inform our customers about any material changes to the privacy policy, for example the purpose for the use of personal data.

8.6 Obligation to retain / deletion of data

The data will be kept for 10 years and then deleted at the end of the contractual relationship.
 

9. Place of jurisdiction, applicable law

These General Terms and Conditions may be modified at any time. Swiss law shall apply exclusively.
The place of jurisdiction is Zurich.
